Pearpop, Inc. (“Pearpop,” “we,” “us,” “our”) is committed to maintaining robust privacy protections for your personal information that we collect from you through Pearpop.AI, an AI-powered email platform for content creators and influencers (“Pearpop.AI”). This Privacy Policy is designed to help you understand how we collect, use, and safeguard the personal information you provide to us and to assist you in making informed decisions when using Pearpop.AI. We reserve the right to modify this Privacy Policy at any time. Changes will be effective immediately but will not apply retroactively.

Information We Collect

We may collect two types of information from you when you use Pearpop.AI:

  • Information that you provide to us; and
  • Information we collect automatically when you use Pearpop.AI.

In some cases, if you chose not to provide us with requested information, you may not be able to use certain functions or features of Pearpop.AI.

Information You Provide To Us

We collect:

  • Your name
  • Basic contact information (phone number, address, email)
  • Your username
  • Social media handle
  • Payment information

All of the above is collectively, “personal information”.

We may collect other personal information from you from time to time. When we do, we will describe the personal information we are asking for and tell you why we’re collecting it and how we’re going to use it.

Information We Automatically Collect When You Use Pearpop.AI

We may automatically receive and record information from your computer or mobile device whenever you access or use Pearpop.AI. This information may include: the device you use to access our use Pearpop.AI, browser or operating system installed on your device, the webpages you visit on Pearpop.AI, the files you viewed, and the website from which you navigated to Pearpop.AI (together, “non-identifiable information”).

How We Use Your Information

We may use your personal information:

  • To provide Pearpop.AI to you.
  • For the specific purpose for which it was collected.
  • To alert you of new products or services, features, or enhancements (i.e. marketing).
  • As permitted by law.
  • For any other purpose with your consent.

We may use and disclose non-identifiable information for any lawful purpose without any obligation or accounting to you. When we do so, we will take reasonable measures to ensure that the non-identifiable data does not and cannot be used to later identify you.

When We May Share Your Personal Information

We may disclose your personal information to third parties as described below:

  • We may share your personal information when we have your consent.
  • We may share your personal information with brands that you want to work with and brands that want to work with you.
  • We employ other companies and people to perform tasks on our behalf and we may need to share your personal information with them to provide Pearpop.AI to you, to respond to your technical support questions, to provide customer support, for payments and other monetary transactions, or to otherwise assist us with Pearpop.AI. Unless we tell you differently, they do not have any right to use your personal information beyond what is necessary to assist us.
  • We may disclose your personal information at the request of law enforcement or government agencies, in response to subpoenas, court orders, or other legal process, or as otherwise required by any law, rule, or regulation to which we are subject. We may also disclose your personal information to protect the rights, property, or safety of another person or to prevent fraud. We may disclose your personal information to investigate or prevent your violation of any contractual or other relationship with us or your illegal or unlawful activities.
  • In the event we undergo a business transaction such as a merger, acquisition by another company, or sale of all or a portion of our assets, your personal information may be among the assets transferred.

Cookies and Internet Advertising

Our advertising partners may also transmit cookies to your web browser, application, or mobile device when you visit Pearpop.AI or click on ads that appear on Pearpop.AI. Clicking on a link to a third party website from Pearpop.AI may also allow that third party website to also transmit cookies to you.

We may also use “web beacons” (i.e. “web bugs” or “single–pixel” or “clear” GIFs) on Pearpop.AI. Web beacons allow ad networks to provide anonymized, aggregated auditing, research, and reporting for us and for advertisers. Web beacons also enable ad networks to serve targeted advertisements to you when you visit other websites. Your Rights

Depending on where you reside, you may have certain rights and choices regarding your personal information. These include:

  • The right to request deletion of your personal information.
  • The right to restrict or object to how we use your personal information.

There may be situations where we cannot grant your request. Where we deny your request in whole or in part, we will take steps to inform you of the denial and provide an explanation of our actions and the reasons for the denial.

We will not restrict or deny you access to our products and services because of the choices you make in connection with your personal information, but please note, certain choices may affect our ability to deliver our services. For example, if you ask us to delete your email address, we will not be able to send you emails about our services and offerings.

We do not sell your personal information and we do not share your personal information as that term is defined in the California Consumer Privacy Act (CCPA).

You may exercise any of your rights in relation to your personal information by contacting us using the details provided in the “Contact Us” section below.

You always have the right to submit a compliant with the relevant government or supervisory authority of your usual place of residence regarding how we process your personal information; however, before doing so, we request that you contact us directly in order to give us an opportunity to work directly with you to resolve any concerns you have about your privacy or how we process your personal information.

Your personal information might be included in emails and other materials that other subscribers upload, store, or have received in their Pearpop.AI account. You will need to reach out directly to the subscriber to account for that personal information or if you want to exercise any rights to your personal information that may be available to you.

Marketing

We may periodically send you newsletters or marketing material via email. You can opt-out of our marketing materials by managing your communication preferences by following the unsubscribe instructions provided in each email.

We only process your personal information if we have a legal or valid business basis, which include:

  • Performance of a contract.
  • Our legitimate interest.
  • Compliance with legal obligations.
  • Your consent.

Consumers Outside of the United States

Pearpop.AI is hosted in the United States and is governed by United States law. If you are using Pearpop.AI from outside the United States, please be aware that your personal information will be transferred to, stored, and processed in the United States.

Shine the Light Disclosure

California Civil Code Section 1798.83 permits consumers that are California residents to request certain information regarding our disclosures of personal information to third parties for such third parties’ direct marketing purposes. Do Not Track

We take reasonable steps to maintain the security of the personal information we collect from you. However, no data transmission over the Internet is completely secure and accordingly, we cannot guarantee the security of any information that you transmit to us, so you do so at your own risk.

Personal Information Retention

We keep personal information as long as it is reasonably necessary for the purposes described in this Privacy Policy. Certain data may be retained until the time limit for any legal challenges has expired or in order to comply with regulatory requirements regarding the retention of such personal information. Where applicable, if any personal information that we hold is no longer required for the purpose for which it was collected and no applicable law requires us to retain that data, we will take reasonable steps to de-identify or destroy the data.

Pearpop.AI may contain links to other websites or applications. This Privacy Policy only applies to Pearpop.AI and not to any website or application that we do not own. We are not responsible or liable for any content, advertising, products, or other materials on or available from third party websites or for any privacy or other practices of the third parties operating those websites. We encourage you to carefully read the privacy policy of any third party website or application before you provide your personal information to those third parties.
